Below we have listed important legal terms that apply to anyone who visits our website or uses our services. These terms are necessary in order to protect both “You” and “Us” and to make our “Services” enjoyable for everyone.

By creating an account with Atcommerce, you confirm that you are in agreement with and bound by the following terms and conditions.

Atcommerce is only willing to provide ecommerce services to you upon the condition that you accept all of the terms contained in this agreement. Please read this agreement carefully as it affects your legal rights and remedies.

The following agreement (“Agreement”) is entered into between you (“User”) and Atcommerce (“Atcommerce”, “we” or “us”) and is made effective on the date of electronic acceptance. By signing up for the Atcommerce service (“Service”), you are agreeing to be bound by the following “Terms & Conditions”. Any addition to the current service (“features” or “tools”) shall also be subject to the “Terms & Conditions”. We reserve the right to update and change the Terms of Service by posting updates and changes to the “Atcommerce.pk”. You are advised to check the Terms & Conditions from time to time for any updates or changes that may impact you.

Account Terms 

  1. You must provide your full legal name, current address, a valid email address, and any other information needed in order to complete the signup process.
  2. You must submit a scanned copy of your national identification card (CNIC) before you start selling on your online store or moving your store to your own custom domain.
  3. You are in charge of keeping your password safe. If you fail to keep your account and password secure, Atcommerce is not responsible for any resulting loss or harm.
  4. You are not permitted to use the Atcommerce service for any unlawful or unauthorized purposes, nor are you permitted to use the Service in a way that violates both Pakistani law and any laws that apply in your country of residence, including but not limited to copyright laws.
  5. You are responsible for all the activities and content (data, graphics, photos, link) uploaded under your Atcommerce account.
  6. You have no right to transmit any worms, viruses, or other harmful codes.
  7. Your services will be terminated immediately if any of the Account Terms are breached or violated, as assessed by Atcommerce in its sole discretion.

General Conditions 

You must read, agree with and accept all of the “Terms & Conditions” contained in this “User Agreement” before signing up for Atcommerce.

  1. We reserve the right to modify or terminate the Service for any reason, without notice at any time.
  2. We reserve the right to refuse service to anyone for any reason at any time.
  3. You use the Service entirely at your own risk. The Service is offered “as is” and “as available” with no warranties or conditions of any kind, either explicit, implied, or legal.
  4. Atcommerce does not guarantee that the service will be uninterrupted, timely, secure, or error-free at all times.
  5. Atcommerce does not guarantee that the outcomes of using the service will be accurate or reliable.
  6. If we determine in our sole discretion that any Content is illegal, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable, or violates any party’s intellectual property or these Terms & Conditions, we may, but are under no obligation to, remove that Content and Accounts containing that Content.
  7. Atcommerce does not guarantee that any faults in the “Service” will be fixed or that the quality of any products, services, information, or other materials purchased or obtained by you through the “Service” will meet your expectations.
  8. You expressly understand and agree that Atcommerce shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the service.
  9. Atcommerce will not be responsible in any way for lost profits or any other special, incidental, or consequential damages resulting from or connected to our site, our services, or this agreement (including negligence).   10. Technical support is only provided to paying account holders and is only available via email.
  11. Without Atcommerce’s prior written consent, you agree not to use, duplicate, replicate, sell, resell, or exploit any part of the Service, including gaining access to it.
  12. Verbal or written abuse of any kind (including threats of abuse or retribution) of any Atcommerce customer, Atcommerce employee, member, or officer will result in immediate account termination.
  13. The content you supply to the Atcommerce service is not subject to any intellectual property rights claims by us. Everything you upload is still your property. You can delete your account at any time to remove your Atcommerce store. Additionally, this will delete all of your Service-stored content.
  14. When you upload images and item description content to Atcommerce, you agree to have them viewed by other internet users as well as for Atcommerce to display and store them. You also agree to Atcommerce having the right to at any time assess all content that you have uploaded to its Service.
  15. Atcommerce’s failure to exercise or enforce any right or provision in the Terms of Service does not signify that these rights or provisions have been granted. Any past agreements between you and Atcommerce (including, but not limited to, any earlier versions of the Terms of Service) are superseded by the Terms of Service, which govern your use of the Service as a whole.
  16. You retain ownership over all content that you submit to a Atcommerce store however, by making your store public, you agree to allow others to view your content.
  17. Atcommerce does not pre-screen Content and it is in their sole discretion to refuse or remove any Content that is available via the Service.
  18. With a Theme from the Atcommerce Theme Store, you may decide how your Atcommerce store will look. If you buy a theme, you get permission to use it just once, for one store. A Theme cannot be sold or transferred to another person’s store on Atcommerce or anywhere else.
  19. Atcommerce reserve the right to display Atcommerce or Atcommerce logo in the footer of your Atcommerce store. You agree not to remove Atcommerce logo from your website footer without the written permission from Atcommerce.

Cancellation and Termination 

  1. You may cancel your account at any time by emailing to us.
  2. Once your account is cancelled all of your Content will be immediately deleted from the Service. Since deletion of all data is final please be sure that you do in fact want to cancel your account before doing so.
  3. Fraud: If Atcommerce suspects that you have engaged in fraudulent behavior in connection with the Site (via conviction, settlement, insurance or escrow inquiry, or otherwise), we may suspend or terminate your account without limiting any other remedies.

Payment of Fees 

Following are the “Terms” for payment that apply to the users.

  1. Atcommerce will charge you the service fees and transaction fees against your selected subscription plan.
  2. For transaction fees, you will be billed a percentage of the total amount of successful orders processed in a given period of time. All subscription plans offer different transaction fees rates.
  3. The service will be billed either in 1 month, 3 months, 6 months or 12 months’ intervals, whichever interval you choose.
  4. Any outstanding balance that hasn’t been charged will be applied to your account on the next billing date. The store owner will receive an email with an invoice that details the fees. The billing page of your store’s admin will show an invoice. Users have around two weeks to bring up and settle any billing-related issues.
  5. If you decide to add a credit or debit card for bill payments, we’ll use the stored card to charge you on the next billing date.
  6. If we are unable to process your bill payment, we may make multiple attempts to automatically charge you using the stored card.
  7. We reserve the right to suspend access to your Account and the Services if the outstanding bill payment is not received within 30 days of the bill invoice. However, after the outstanding payments are paid, your Account will be reactivated. During the time of suspension, you might not be able to access your Account or your store.
  8. If the subscription charges or transaction fees remain unpaid for 14 days after the due date, Atcommerce reserves the right to take necessary actions, including denying access to the admin area, restricting viewing of received orders or terminating your store.
  9. Atcommerce does not provide any partial or full refunds.

Fair use Policy

The following terms applies to the customers of Atcommerce authorized partners.

  1. Resource usage: You are responsible of making sure that your use of the Service doesn’t go beyond what is permitted in terms of storage, bandwidth, and other resources. If you go beyond these limits, we retain the right to restrict or end your access to the Service or any part of it.
  2. Abuse: We reserve the right to suspend or terminate your access to the Service if we reasonably believe that you are using the Service in a manner that violates this Fair Use Policy or applicable laws, or if you engage in any conduct that we determine, in our sole discretion, to be abusive, inappropriate or harmful.
  3. Free Plan: If you utilize the Free Plan, you should be aware that if there hasn’t been any action on your account for 30 days, we reserve the right to terminate your online store. We consider you to be inactive if you haven’t logged into your admin area, made any purchases or store modifications, or interacted with customers on our platform.
  4. It is important to note that once your account is closed, all associated data will be deleted and cannot be retrieved.
  5. Make sure to regularly log in to your account and interact with your customers to keep your account active and prevent any unexpected closures. This can involve adding new products to your store, answering inquiries from customers, and advertising your store through marketing channels.
  6. We reserve the right to modify or update this Fair Use Policy at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Fair Use Policy.

Modifications to Prices

  1. The following terms applies to all of the Atcommerce’s customers.
  2. Prices for using Atcommerce are subject to change upon 14 days’ notice from Atcommerce. Such notice may be provided at any time by posting the changes to the Atcommerce site (www.Atcommerce.pk) or the administration menu of your Atcommerce store via an announcement.
  3. Atcommerce shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
